Guardianship, Civil Commitments & Ad Litem Certifications Seminar

Back in June 4, 2015, Paul Romano and I spoke at the Fort Bend Chapter of NAMI (the National Alliance on Mental Illness). We appreciated the opportunity to present for NAMI, and thought that the presentation was very successful.

The plan for this event was to present on the following:

  1. The Powers of Attorney – Covers the durable power of attorney, medical power of attorney, HIPPA release form, and the Declaration of Mental Health Treatment forms that caregivers can utilize when a loved one is in crisis.
  2. Guardianship – An overview of how to begin this process, when you should file for Guardianship, what you might be liable for, and the limitations that accompany this important role.
  3.  Civil Commitment – An overview of Texas laws that govern the involuntary commitment of a loved one who is in crisis. Paul Romano walks through the steps in the Mental Commitment process which includes:
  • Emergency Detention;
  • Protective Custody;
  • Temporary Commitment (up to 90 days);
  • and Extended Commitment (12 months).

Guardian Holding child's HandPaul walks you through the legal proceedings in which someone with a mental illness is committed to a mental health facility against their will.  In the state of Texas the Involuntary Commitment process is governed by the Texas Constitution and the Texas Health & Safety Code.

Unfortunately, time was cut short on Paul’s portion of the presentation, Civil Commitment, so he wrote up a summary of that presentation. We also decided that at a future date, we would give our presentations in full once again.

That time has come, and we are proud to be speaking this Friday October 23, 2015 at the Houston Volunteer Lawyers Seminar. Slides for our presentation will be made available online for those who are interested, but cannot make the event. These can be found below the press release.

Guardianship & Mental Health Commitment

If you or a loved one is in need of legal counsel regarding the guardianship process or mental health commitments, please do not hesitate to contact our office today. We strongly suggest you seek the advice of an experienced attorney when faced with these situations. The laws and legal proceedings that have been developed for guardianship and civil commitments are in place for a good reason. However, without the guidance of an experienced legal team, they can be very daunting for a person to walk through on their own.
